CAP 369AJ MERCHANT SHIPPING (SAFETY) (NAVIGATIONAL EQUIPMENT) REGULATIONS
| (Cap 369 section 98 and 107) [2 August 1991] (L.N. 322 of 1991) Cap 369AJ reg 1 Citation (1) These regulations may be cited as the Merchant Shipping (Safety) (Navigational Equipment) Regulations. (2) (Omitted as spent) (Enacted 1991) Cap 369AJ reg 2 Interpretation and application GENERAL (1) In these regulations, unless the context otherwise requires- "cargo ship" (货船) means any ship which is not a passenger ship; (L.N. 409 of 1995) "constructed" (建造) in respect of a ship means a stage of construction where- (a) the keel is laid; or (b) construction identifiable with a specific ship begins; or (c) assembly of that ship has commenced comprising at least 50 tonnes or 1% of the estimated mass of all structural material, whichever is less;"Department of Transport" (运输部) means the Department of Transport of the United Kingdom Government; "Hong Kong ship" (香港船舶) means a ship registered in Hong Kong; "interference" (干扰) means the effect of unwanted energy due to one or a combination of emissions, radiations, or inductions upon reception in a radiocommunications system, manifested by any performance degradation, misinterpretation, or loss of information which could be extracted in the absence of such unwanted energy; (36 of 2000 s. 28) "international voyage" (国际航程) means a voyage from a port in one country to a port in another country; "maintenance" (维修) means any activity intended to keep an installation in satisfactory working condition and includes tests, measurements, replacements, adjustments and repair; "Merchant Shipping Notice" (商船公告) means a Notice described as such, issued by the United Kingdom Department of Transport, and includes a reference to any document amending or replacing that Notice which is approved by the Director and notified to this effect in the Gazette; "the Organization" (组织) means the International Maritime Organization; "Passenger Certificate Class IIA" (第IIA类乘客定额证明书) means a certificate issued under or pursuant to the Ordinance for ships engaged on voyages of any kind other than international voyages; "passenger ship" (客船) means a ship carrying more than 12 passengers; "radar watch" (雷达值班) means observing displayed radar information, the frequency of observation depending upon the prevailing conditions; "safe distance" (安全距离), in relation to a unit of equipment, means the minimum distance, approved by the Director of Marine and specified on that unit, at which the unit should be installed from a magnetic compass, in order to minimize deviation to the compass; "tanker" (液货船) means a cargo ship constructed or adapted for the carriage in bulk of liquid cargoes of a flammable nature; "Telecommunications Authority" (电讯管理局局长) means the Telecommunications Authority appointed under section 5 of the Telecommunications Ordinance (Cap 106); (36 of 2000 s. 28) "tons" (吨) means gross tonnage and shall be- (a) for a ship having alternative gross tonnages under paragraph 13 of Schedule 5 to the Merchant Shipping (Registration) (Tonnage) Regulations (Cap 369 sub. leg.) the larger of these tonnages; (b) for a ship having its tonnage determined both under Part II and regulation 16 of those regulations its gross tonnage as determined under regulation 16.(2) References in these regulations to any performance specification shall be construed as references to- (a) the performance specifications specified in the Merchant Shipping Notice No. 1138 (referred to in regulations 15, 18(1), 27, 29 and 39 hereof); and (b) the appropriate performance specification issued by the Telecommunications Authority (referred to in regulations 31, 33(3) and 37),and shall include a reference to any document amending any such specification which is considered by the Director to be relevant and is notified in the Gazette. (3) These regulations apply to- (a) Hong Kong passenger ships; (b) other Hong Kong ships of 150 tons or more; and (c) other ships of 150 tons or more while they are within the waters of Hong Kong,but do not apply to any pleasure vessel, fishing vessel or any vessel required to be licensed under Part IV of the Shipping and Port Control Ordinance (Cap 313). (4) A rigidly connected composite unit of a pushing vessel and associated pushed vessel, when designed as a dedicated and integrated tug and barge combination, shall be regarded as a single ship for the purpose of these regulations. (Enacted 1991) Cap 369AJ reg 3 Provision of navigational equipment installations (1) Every ship shall be fitted with a magnetic compass installation and comply with Part I. (1A) (a) Subject to paragraph (b), every passenger ship and every cargo ship of 300 tons or over, when engaged on an international voyage, shall be fitted with a radar installation capable of operating in the 9 GHz frequency band and shall comply with Part III. (b) The Director may, at his discretion, exempt passenger ships of less than 500 tons and cargo ships of 300 tons or over but less than 500 tons from complying with regulation 18(1) of Part III provided that the radar installation is fully compatible with the radar transponder for search and rescue.
